電子競技是近年來席捲全球之熱門產業,我國躬逢其盛,不但為電子競技賽事創造可觀的收視流量,亦誕生不少揚名國際之選手,然而,伴隨此一百億產業而生的,卻是各式各樣的契約糾紛、裁罰爭議與過勞工作之疑慮。本論文嘗試由電子競技活動基本面上探討此領域紛爭不斷之根本原因,由於當前主流電子競技遊戲開發商皆為美國公司,本文參考美國文獻,分析電子競技產業之流變及組織結構,進一步定性電子競技選手之工作契約,釐清選手與其雇主乃至於電子競技聯盟間之權利義務關係。此外,電子競技雖自詡為運動,我國亦於2007年將其納入運動產業發展條例,但電子競技聯盟與傳統職業運動聯盟恐難簡單類比,畢竟在遊戲開發商手握智慧財產權之情況下,其

產業權力結構大幅朝資方傾斜,嚴重壓縮電子競技選手之協商地位,選手們往往僅能被迫接受不甚理想之勞動條件,不少學者因而紛紛呼籲電子競技選手仿效傳統運動員組成工會,只不過,電子競技產業之特殊性又爲此一選項創造更多障礙。另一方面,由於我國勞動基準法排除適用職業運動員,使臺灣電子競技選手面臨更加不利之勞動處境,既缺乏傳統職業運動聯盟之團體協商,又無最低勞動條件之保護,不難想像其血汗過勞之惡名從何而來。有鑑於此,本文參酌英美法規文獻,分析電子競技管理方法之利弊,為我國電子競技選手之勞動法規提出建議。

職業棒球由於高度的娛樂價值已經成為企業爭相贊助的對象之一,球隊母公司為追求更多的球隊勝利對於投手聘請投注極大心血,卻無一個考量多目標的效率指標作為薪資標準。本研究採用二階段資料包絡分析法 (two-stage data envelopment analysis) 及共同邊界函數 (meta-frontier function) 建構投手績效模型,並評估跨國家、跨聯盟棒球投手技術落差,探討效率、薪資與投手特性變數之間的關係;本研究以防禦王入選資格作為門檻,擷取2013年美國棒球大聯盟 (Major League Baseball, MLB) 及日本職棒聯盟 (Nippon Profession

al Baseball, NPB) 例行賽的投手作為研究樣本。研究結果顯示以非意欲產出模型所建構之投手績效模型呈現較高的區別力,跨國比較方面NPB技術水準表現較MLB佳;影響因素方面,MLB薪資對效率有正向顯著影響、效率對薪資卻無顯著影響,反觀NPB績效與薪資互為正向顯著影響關係;此外MLB投手年齡、任期與市場規模對薪資成正向影響,換隊頻率對薪資有負向影響,任期對效率有負向顯著影響,NPB投手則是任期對薪資有正向顯著影響、對效率為負向顯著影響。建議棒球產業關係者除了應依憑客觀數據來改善選手表現外,薪資方面更應依照績效表現給付,還需擬定完備之配套措施,以留住人才振興棒球產業。
