The global outbreak of the COVID-19 virus has been the single greatest shock to the international system in recent years. This health crisis has placed an incredible strain on medical institutions across the globe as they struggle to keep up with both international resource demand and new viral gen

etic variants. Likewise, international crises have historically proven as useful case studies to test the governing capacity of states and institutions under considerable stress. Within the context of COVID-19, states have been compelled to implement a series of emergency responses, including expand

ing police powers, restricting domestic movement, and barring international travel. Due to the heavily politicised nature of this health crisis, the capability of governing authorities to elicit compliance with these policy models has varied greatly. For theorists of compliance, understanding and im

plementing effective and contextualised mechanisms of engendering compliance is imperative for success. This paper seeks a further understanding of this concept by contextualising it within the COVID-19 epidemic, examining the domestically employed policy models—and methods of implementation—engaged

with by India and ROC during the initial outbreak of COVID-19 (January-April, 2020). The interviews conducted for this research highlight emerging themes pertaining to the roles of culture, infrastructure, and state capacity in achieving domestic compliance with such policy models.

依據我國商標法第63條第1項第2款規定,若商標註冊後無正當事由迄未使用或繼續停止使用已滿三年者,商標專責機關應依職權或據申請廢止其註冊,所以商標權人在取得商標註冊權利後被賦予了商標使用的義務,否則即構成得申請廢止商標註冊之事由,但實際上有許多商標權人並非完全沒有使用其註冊商標,只可能因其企業經營規模較小或財力較為不足,而只能在小區域、小市場中少量使用其註冊商標,也因此在消費者的認知中,較無法建立起其註冊商標與商標權利人的連結關係,進而衍生「反向混淆(Reverse Confusion)」之情形,前述的現象在消費者的眼中,可能會混淆及誤認後使用相同或近似該商標的人才是真正合法的權利人。

各國的法院判決或專家學者們大多認為若發生「反向混淆」時,先使用商標或先取得註冊商標的權利人應受到商標法的保護,而後商標使用人應被科予侵害商標權的責任。判決的理由是法律應保護的,並非僅是該權利人的商譽,也應該保護該權利人持有商標權所涵蓋及創造出的經濟利益,以及其未來可能衍生出來的經濟利益。但在不同的案例中,有時法院也會有不同的見解出現,乃認為應保護已投入大量行銷資金建立商標品牌知名度及商譽的後商標使用人。「反向混淆」在我國商標法的適用,當發生「反向混淆」的侵權態樣時,法律究竟應該保護先註冊商標權人呢? 還是應該保護後商標使用人呢? 法律應該如何解決二者的衝突呢? 本文想藉由美國及臺灣法院

在面對「反向混淆」相關情事的判決時,對於應受保護對象所持的不同見解及爭點,來儘量討論及歸納出法院判決的理論基礎及其衡平標準。
