中文摘要隨著科技的進步與電子商務的發達，近年來支付方式與制度起了巨大的變化，過去的支付工具離不開現金、金融卡與信用卡，如今因手機已經成為現代人日常必需品，將手機作為錢包的新形態支付工具如雨後春筍般興起。而手機支付的核心概念是「虛擬」，將貨幣與卡片虛擬化、電子化，再透過手機本身的硬體或軟體安裝進行支付行為，除了免去零錢的兌換與存放外，在交易系統上也比POS機更為簡易並已發展成為更方便的支付環境。在法源基礎上，我國並無直接規範行動支付的專法，而是針對設立行動支付的各種支付機構加以訂定法規。如此一來，雖然透過手機進行交易皆可稱之為行動支付，但因支付機構的類型不同，在設立標準、執行權限上都反映出差異

性。我國現有的行動支付業者可分為電子支付機構、第三方支付業者、一般業者（以電子禮券形式推行）等三類，電子支付有最高的權限，但卻同時須負擔相對應的較高要求與門檻；從用戶角度來看，可能只差在轉帳金額上限與可否儲值的操作規範，但對於業者而言，成為電子支付業者的最低實收資本額需5億元，其暫時收受款項的存放與利用皆受限制，同時亦有完整的、類似於金融機構的用戶權益保護、安全控管、洗錢防制義務等。藉由介紹、比較與分析我國與美國、歐盟、中國大陸之行動支付規範差異，本研究認為台灣之管制密度較各國為高，且充分區分電子支付與第三方支付的作法在他國中亦較為少見，這可能會更加凸顯介於其間的模糊地帶，進而造成混淆甚至存有

法律漏洞。本研究最後總結前述之觀察與分析，並對我國行動支付相關法制與業者執行層面提出建議供決策者參考。
